We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website, then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and www. sportscise.com’s rights and obligations to each other. As a result, by using the website of Sportscise (Website), you are agreeing to be bound by these terms and conditions.

LIMITATION OF LIABILITY

It is an essential pre-condition to you using our website that you agree and accept that www.sportscise.com is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third-party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable. The Website may provide links to third party websites and the products or services of third parties. We disclaim all responsibility and liability in any way. Your access or use of any third party sites is at your own risk. The Website may from time to time display third party advertisements. Such advertisements may or may not contain hyperlinks to third party websites. We do not endorse or recommend the goods or services of advertisers or their websites.

Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only; and you may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.

You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.

COMPETITION AND CONSUMER ACT

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), www.sportscise.com’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

You must be over 18 years of age to use this website and to purchase any goods or services.

We may at any time discontinue or limit access to the Website or its content. We may terminate or limit your access to the to the Website if you breach these conditions. All disclaimers and limitations of liability by us will survive termination.

The prices of our products are the prices displayed on the Website on the date of your order (inclusive of Goods and Services Tax (GST) and any other charges which must be mandatorily disclosed under the Competition and Consumer Act 2010 (Cth)).

All prices displayed on the Website are quoted in Australian dollars and must be paid in full, except where discounts are offered as detailed on the Website. You may not cancel an order once it has been submitted and paid, even if a confirmation email from us is still pending.

All online purchases are governed by the terms and conditions of the use of our programs, copies of which are available online.

You acknowledge that despite our reasonable precautions, our products may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error, unavoidable circumstances, or other oversight. In these circumstances, we reserve the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged.

If a cancellation occurs in accordance with these terms and conditions, after your credit card has been charged for the purchase, we will immediately offer to reschedule your booking on a day and time of your choosing.

We reserve the right to make any changes to the details and these terms and conditions if necessary to comply with any applicable legislation and to change the details and conditions published on the Website, without affording notice, provided that this does not materially affect the nature of our products purchased by you.

When you click on the “I Agree” checkbox when purchasing items from the Sportscise Website, you agree to these terms and conditions, and we will treat the order as confirmed. You are responsible for ensuring the accuracy of your order. We will supply you, subject to availability, with the products set out in your order. We will confirm each order made online via the Website or by email within two (2) business days. When purchasing from the Website your financial details are passed through a secure server.

No transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information, which you transmit to it. Accordingly, any information which you transmit to us, including your credit card details, is transmitted at your own risk and we have no liability to you for any financial or consequential loss or damage suffered by you in anyway whatsoever arising out of or related to your use of this website whether due to negligence, breach of contract, statute, or statutory duty by us.

Once We receive your transmission, we will take reasonable steps to preserve the security of such information. These terms and conditions are governed by and construed firstly in accordance with the laws of the State of South Australia (the courts of which have exclusive jurisdiction) and then in accordance with the laws of the Commonwealth of Australia. If any of these terms and conditions should be determined to be void, invalid or otherwise unenforceable, such conditions are deemed deleted and the remaining terms and conditions remain and continue to be valid, binding, and enforceable.

FITNESS AND EXERCISE

Exercise and health are matters that vary from person to person. You should understand that when participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in this exercise or exercise program, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge www.sportscise.com, all its instructors, commentators and any associated with the www.sportscise.com website from any and all claims or causes of action, known or unknown.

Content in www.sportcise.com is provided for information purposes only. It is not intended to replace advice from a doctor, qualified practitioner or other registered health professional about choices pertaining to your health. All users are urged to seek their own advice from a registered health care professional for answers to their questions about their own health and physical recommendations and if this program content is suitable for their own personal situation.

www.sportscise.com and its contents are made available without warranties or guarantees of any kind and www.sportscise.com, any contributing author(s) of any articles including any third party contributors, disclaim any and all liability for any type or form of injury, including personal, direct, indirect or consequential or damage of any kind or type resulting from the use of this website or from any information, advice, goods, services or other resources that may be mentioned or made accessible through this website. This includes personal physical injury from performing any exercise described, or any and all forms of injury and/or damage to person, both animate or inanimate, mental, physical, electronic or any and other form of injury. We also disclaim liability caused by intentional or unintentional negligence.

You should always consult a physician before starting a fitness program or changing your diet. Not all exercises, nutrition programs or activities are suitable for everyone. DELIVERY OF GOODS

Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of www.sportscise.com.

Digital goods are delivered immediately. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

REFUND POLICY

Sportscise (We, Our, or Us) does not offer any refunds for pre-purchased tickets or deposits. Customers who have pre-purchased tickets may not exchange their time slot for another, unless agreed to by Our manager.

Tickets are valid only for the date and time shown and are void if tampered with. They remain Our property and are non-transferable.

We are entitled to cancel your booking at any time. If We decide to cancel Your booking, We will use reasonable endeavours to notify You as soon as possible. You are entitled to a full refund or the option to reschedule if We cancel in these circumstances at the discretion of Our manager, but no other compensation is payable.

RETURNS

Should you wish to return your order, please notify us within 7 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly, and payment made by the same method that you made payment. All refunds are made at the discretion of www.sportscise.com.

DISCLAIMER

To the fullest extent permitted by law, www.sportscise.com absolutely disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose. www.sportscise.com gives no warranty that the documents, goods or services will be free of errors, or that defects will be corrected, or that our website or its server is free of viruses or any other harmful components.

Whilst we, at all times endeavour to have the most accurate, reliable and up-to-date information on our website, we do not warrant or make any representations regarding the use or the result of the use of any document, product, service, link or information in its website or as to their correctness, suitability, accuracy, reliability, or otherwise.

It is your sole responsibility and not the responsibility of www.sportscise.com to bear any and all costs of servicing, repairs, or correction. The applicable law in your state or territory may not permit these exclusions, particularly the exclusions of some implied warranties. Some of the above may not apply to you but you must ensure you are aware of any risk you may be taking by using this website or any products or services that may be offered through it. At www.sportscise.com, we are committed to protecting your privacy. We use the information we collect about you to maximize the services that we provide to you. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. Please read our separate Privacy Policy carefully.

You may change your details at any time by advising us in writing via email at hello@sportscise.com All information we receive from our customers is protected by our secure servers. www.sportscise.com’s secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. Credit card information is not stored by us on our servers.

THIRD PARTIES

We do not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and assist in meeting customer needs generally. In addition, we may use the information that you provide to improve our website and services but not for any other use.

DISCLOSURE OF INFORMATION

www. sportscise.com may be required, in certain circumstances, to disclose information in good faith and where www.sportscise.com is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.

EXCLUSION OF COMPETITORS

If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of www.sportscise.com expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party. If you breach this term, then Sportscise will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. Sportscise reserves the right to exclude and deny any person access to our website, services, or information in our sole discretion.

EXCLUSION OF UNENFORCEABLE TERMS

Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

WHOLE AGREEMENT

These terms and conditions represent the whole agreement between you and Sportscise concerning your use and access to www.sportscise.com’s website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

JURISDICTION

This agreement and this website are subject to the laws of South Australia and Australia. If there is a dispute between you and Sportscise that results in litigation, then you must submit to the jurisdiction of the courts of South Australia.

 

SPORTSCISE SCHOOL PROGRAMS

These terms and conditions apply to services provided by Sportscise School Programs.

Please carefully read our terms and conditions carefully before purchasing a service from Sportscise and keep a copy for your records.

In agreeing to your child attending a Sportscise program, I:

Release and forever discharge Sportscise from all claims that I may have or may have had arising from, or in connection with, my child and a Sportscise physical or online program; and Indemnify, will keep indemnified and hold harmless Sportcise, to the extent permitted by law in respect of any claim as a result of or in connection with a Sportscise physical or online program.

I warrant that my child has not at any time suffered blackout, seizure, convulsion, fainting, dizzy spells or any other medical condition and is not presently receiving treatment for any illness, disorder or physical injury which would render it unsafe for my child to take part in a Sportscise program. I have read and I consent for my child to participate in a Sportscise physical or online program and understand the risks involved and further agree to be bound by the Sportscise Code of Conduct and operating rules outlined in the Privacy agreement and contract of online membership.

I acknowledge that Sportscise uses its best endeavours to ensure that the equipment and sporting facilities used in the program are safe and fit for purpose and acknowledge that all sports are inherently dangerous. I have voluntarily read and accept the inherent associated risks. “Sportscise” means all directors personally and in their capacity as a director, partners of directors, agents, and any representatives of Sportscise. “Sportscise Program” includes all physical and online programs and activities that you or your child participates in during our classes/events. This includes but is not limited to any organised sport, fitness workouts, training, facilities and activities provided by Sportscise. The registered participant is physically fit to take part in activities at Sportscise, no current or previous medical conditions will affect their participation.

SERVICES OFFERED

Include, but not limited to; after-school weekly term-based classes, birthday parties, school holiday programs, school incursion/excursion programs and events.

TIMETABLE CHANGES

Classes timetables are subject to change. While Sportscise uses its best efforts to operate classes as per the timetable published on our website, in some instances changes are required due to unforeseen circumstances. No guarantee is made that classes will run 100% as per the advertised timetables. Any changes to the advertised timetables will be communicated to those affected prior to the commencement of the class/event.

MEDICAL ASSISTANCE

I consent to receive and agree to pay for any reasonable medical treatment for the above-mentioned participant (including transport by ambulance) considered advisable by the Sportscise medical staff, prior, during or after any activities at Sportscise.

PERMISSION TO RECEIVE EMAILS

I give permission and express my consent to receive emails from Sportscise in regard to important information, upcoming events, programs, marketing, newsletters and other Sportscise related content.

PERMISSION TO RECEIVE SMS/MSM/iMessage

I give permission and express my consent to receive messages to my mobile from Sportscise in regard to important information, upcoming events, programs, marketing, newsletters and other Sportscise related content.

REJECTION AND EXPULSION

All rules and conditions will be adhered to. The coaches & supervisors reserve the right at their discretion to reject or cancel entry at any time, including but not limited to reasons of safety, insurance, or if in the opinion of the supervisors, the above-mentioned participants are unfit to participate at Sportscise for any reason.

PAYMENT TYPES

We accommodate varied payment methods via credit card or bank account. Cash payment or casual memberships are not accepted (we do not accept AMEX/Diners cards).

Some programs require upfront payment in full prior to attending.

PAYMENT POLICY

Our payments are managed through a third-party direct debit company who act on behalf of Sportscise. Your bank statements will refer to ‘Sportscise’ when payment is debited from your nominated account. You will be issued with an invoice for all bookings whereby the amount is due as per the date stated on the invoice.

CORONAVIRUS POLICY

Our business upholds each States health and safety requirements in regards to current Coronavirus COVID-19 pandemic advice. Our staff will ensure a clean environment where hand sanitiser is mandatory before and at the conclusion of each session. Our equipment will remain clean and sanitized. Social distancing will be required for adults in attendance where face masks may be worn as per current Government stipulation. Coaches will not wear masks when coaching children. Please refer to our Covid Safe Plan for more information on our website.

MEMBERSHIP STARTER-PACK & MERCHANDISE

Each new member can chose to pay a one-off $30 joining fee with their initial payment that entitles each child to a Sportscise Starter-Pack that includes; a Sportscise kids tee-shirt, sports headband and drink bottle that will be given to the child in their 2nd week of the term. Sportscise may sell various branded merchandise from time to time at the value as per invoice applicable to the location you have booked a program with.

WEATHER POLICY

Wet/cold weather: outdoor sessions will be moved to an indoor or undercover location if it rains and or is extremely cold (below 5 degrees). Where an alternative location is not available the session will be postponed or cancelled. The cost for a cancelled class due to weather cannot be reimbursed.

Hot weather: children are to attend outdoor sessions wearing a hat, sunscreen and bring a drink bottle. Where sessions run for over an hour, we will provide additional sunscreen. In the case of extreme heat any outdoor classes will be moved to an indoor or undercover location or may be postponed or cancelled. Indoor venue sessions without air-conditioning will be cancelled if the temperature reaches extreme heat (over 32 degrees). The cost for a cancelled class due to weather cannot be reimbursed.

CANCELLATION

To enable our business to remain viable we are required to have strict guidelines on refunds. This is mainly due to venue hire and operational expenses to run our classes/events.

NO REFUNDS ARE AVAILABLE including where deposits have been paid. Notification to cancel your child’s membership must be emailed to hello@sportscise.com

Upfront term class payments cannot be refunded (nor can vouchers be refunded that were used towards payment).

Holiday programs, Birthday parties, Online memberships and other Sportscise bookings cannot be refunded once paid.

Deposits paid towards a booking are also not refundable.

SUSPENSION AND MAKE-UP CLASS POLICY

If your child is unable to attend their program due to illness or travel we are unable to suspend their membership, however they are welcome to attend a make-up class where convenient.

REFUND POLICY

We offer a FREE TRIAL class to ensure that both you and your child are satisfied with our program prior to joining. Therefore, NO REFUNDS ARE AVAILABLE (this applies to all Sportscise program bookings where paid). Where a Sportscise membership applies, please refer to our cancellation and suspension policies within this document. A trial is exactly that, it is used to assess your child’s suitability to our program. However, there are circumstances where we may be required to refuse your child joining our program due to the nature of being unsuitable, if this occurs, we trust you will be respectfully advised the reason/s why. If you pay up-front for a term (or part thereof) there are no refunds offered for missed or unattended classes.

A refund will not be granted if:

·        The participant is absent

·        The participant no longer wishes to attend

·        The participant is unable to attend.

·        The participant is expelled for misconduct

 

PARENTAL ATTENDANCE

Parents and or a Guardians are not required to be present for the duration of each class. We encourage parents to drop off your child and return to pick them up when the class finishes. We value the importance of a child’s independence that helps to support their confidence and growth. However, if you would like to stay and watch you are welcome. Some locations and classes are also suitable for parents/adults to join in and participate in the class, in this instance we ask that adults be aware of their ability beyond a child’s and ensure they act safely and harmoniously. We highly value the benefit of parents supporting their child in their health and wellbeing development.

PHOTOGRAPHY & SOCIAL MEDIA

From time to time your child may be photographed or filmed on video whilst undertaking a Sportscise class/event. Such footage might be used for promotional purposes, including but not limited to reproduction on the Sportscise website and social media platforms such as Facebook, Instagram and YouTube. By joining and/or paying for a Sportscise program you hereby agree to such use by Sportscise. Parents are not to take videos or photographs that include other children without the permission of said parent/guardian. It is your right to request your child’s image not be publicly displayed, if you wish for this not to occur, please email hello@sportscise.com

FOOD AND DRINK POLICY

It is prohibited for food to be consumed during any Sportscise class, however longer duration programs such as holiday classes or parties may require snack and or lunch to be included. Some of the facilities we operate in have strict policies where food cannot be consumed on the court/venue. Any child found to be consuming food during a class will be asked to leave the venue immediately. Our classes are structured to include drink breaks so children must bring a water filled drink bottle with them to each class. Where children attend a Sportscise party or holiday program they are to abide by the instructions of the venue/program requirements advised. Children must provide their own labelled water bottles to attend a Sportscise session.

CYBER SECURITY

The cyber security of all children is our parament objective. The protection of your child’s safety is our most important role, we endeavor to only use trusted secure online and digital platforms. It is your right to request your child’s image not be publicly displayed, if you wish for this not to occur, please email hello@sportscise.com

ONLINE PROGRAMS

Sportscise ‘On Demand’ programs online are the intellectual property of Sportscise and are created for paid members only. Upon becoming a Sportscise Online member, you agree to pay for access where you will be invited to join our private Facebook group and have unlimited viewing. Please do not share your access with others.

All online members are required to join our private Facebook ‘Sportscise On Demand’ group where new classes will be uploaded, and all communication centrally noted. If you do not have Facebook please send us an email to advise and a link will be sent via email. Upon request to join the Facebook On Demand group you will be asked a series of security questions to verify only trusted paid members join this group. Our private Sportscise On Demand Facebook group will house all online class videos and required communication to online members. On Demand means our class links will stay active where you have exclusive viewing at any time, on-demand. Class videos are uploaded via a ‘private’ Sportscise YouTube channel for your exclusive viewing anytime.

CONTROL OF SHARING

Members are not permitted to share links or videos of Sportscise class videos in order to protect our intellectual property.

CONDITIONS OF SALE

The following conditions of sale (Conditions) will apply to and bind the purchaser of any goods or services supplied by Sportscise (We, Our, or Us). The Conditions are also emailed to you when you make a booking and are available on our website at www.sportscise.com (Website).

EXCLUSION OF LIABILITY – WAIVER OF RIGHT TO SUE – YOUR ASSUMPTION OF RISK – THESE CONDITIONS AFFECT YOUR LEGAL RIGHTS

We, as the supplier of recreational services, (a) sell all tickets and (b) supply all recreational services and facilities to you including, sports-based exercise programs and challenges, rental and maintenance, the condition, layout, construction, design, maintenance and use of equipment, the presence of people or objects on equipment, the surrounding areas and any other sporting or leisure time pursuits (Physical and/or Recreational Activities) are subject to the Conditions.

RISK ACKNOWLEDGEMENT

By purchasing a ticket, accepting a discounted or complimentary pass to one of our Sportscise programs:

a) You agree to have understood and be bound by these Conditions and that these Conditions are deemed to have been signed by you for the purpose of the exclusion of liability under section 42 of the Fair Trading Act 1987 (SA) (Fair Trading Act); and

b) are deemed to have accepted our privacy policy on the Website.

You acknowledge and agree that We, Our staff, management, directors and agents are not liable to You, Your dependants or legal representatives for personal injury, disability or death suffered by You whatsoever because the Physical and/or Recreational Activities were not supplied with due care and skill or were not reasonably fit for their purpose or because of the negligence, breach of contract, statute or statutory duty Us.

You acknowledge and agree that the Physical and/or Recreational Activities are dangerous with many inherent risks and hazards and as a consequence personal injury, disability and sometimes death can occur, and You assume and accept all such risks and waive the right to sue us for any personal injury, disability or death in any way whatsoever caused by or relating to your participation in the Recreational Activities.

You acknowledge and agree that you, your children and children for whom you are responsible, are in good health and that you, your children and children for whom you are responsible are free from any adverse medical conditions.

If you have health concerns, before you engage in any Physical and/or Recreational Activity, you should seek approval from your medical practitioner.

CONDITIONS OF SALE

While using one of our Sportscise programs you:

a) agree to pay the cost of and authorise us to take all steps we consider reasonably necessary to ensure the protection of your welfare in the event of personal injury, including but not limited to the administration of any emergency medical treatment and ambulance transportation;

b) consent to images and video being taken for security or promotional purposes of yourself, your children or of children for whom you are responsible;

c) agree to protect and hold safe any of your personal belongings. We are not in any way responsible for any articles that may have been lost or stolen during one of programs; and

d) must comply with all signs or other directions and we may suspend or cancel your access to Recreational Activities at one of our programs in our absolute discretion for non-compliance with these Conditions, or for reckless or careless conduct, aggressiveness and any other behaviour deemed unsuitable by Us.

Except as provided for in in our ticket refund policy, tickets issued by us:

a) remain our property and cannot be refunded, transferred or resold (unless otherwise provided for Us);

b) are valid only for the date shown; and

c) are deemed void if tampered with.

A deposit is required to secure a program booking, and full payment made prior to your visit. The deposit and the full payment made in advance are non-refundable, except as provided for in our ticket refund policy.

These Conditions are governed by the laws of the State of South Australia, the courts of which have exclusive jurisdiction. If any of these Conditions are determined to be void, invalid or otherwise unenforceable, such conditions are deemed deleted and the remaining Conditions remain and continue to be valid, biding and enforceable.

WARNING: If you participate in these activities Your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in or on this notice. The change to your rights, as set out in or on this notice, does not apply if your death or injury is due to gross negligence on the supplier's part. "Gross negligence", in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
